KANSAI PLASCON XPLORE THE WONDERS! TRAVEL CAMPAIGN

1. Terms and Conditions

a. These terms and conditions, together with such additional terms and conditions and information as may be displayed on the website www.plascon.co.za  or www.xploreplascon.com website (the “Website/s”), govern the Kansai Plascon “Xplore the Wonders!” Campaign (the “Campaign”). These terms and conditions, and the additional terms and conditions and information on the website will be collectively referred to as the “terms and conditions” below.

b. The organiser of the Campaign is Kansai Plascon (Pty) Ltd (the “Organiser”), 10 Frederick Cooper Drive, Factoria, Krugersdorp, South Africa. For assistance or enquiries relating to the Campaign, please contact the Organiser’s sales representative that you normally deal with. 

c. The Organiser may amend, alter or update these terms and conditions at any time by publishing the amended, altered or updated terms and conditions (“Updated Terms”) on the Websites. The Participant will be automatically bound by the Updated Terms.

2. Acceptance of Terms and Conditions

a. In order to participate in the Campaign, the participant must be an authorised customer of the Organizer who purchases decorative coatings products from the Organiser and who has a unique store account number (referred to as a “Participant” herein). By participating in the Campaign, every Participant agrees to be bound by and adhere to the terms and conditions, as amended, altered or updated from time to time. A Participant may not participate in the Campaign unless they accept these terms and conditions, as may be updated or altered from time to time. Participation in the Campaign is subject to compliance with these terms and conditions as well as all terms and conditions that may be set out on the Websites or in the Organiser’s literature relating to the Campaign.

b. Persons who are employed by Participants must review, understand and comply with their employer's policies regarding eligibility to participate in trade promotions such as the Kansai Plascon “Xplore the Wonders” with Plascon Campaign. Participants, and persons employed by them, must not participate in the Campaign if they are not allowed to do so.

3. Applicable period

a. The Campaign will be open for participation from 01 March 2017 to 30 November 2017 (the “Campaign Period”).


4. Participant Restrictions

a. This Campaign is open only to Participants from South Africa, Lesotho, Namibia, Botswana, Malawi, Zimbabwe, Zambia and all other countries in which the Organiser has authorised customers with unique store account numbers.

b. The Campaign is not open for participation by the Organiser’s employees (excluding such sales personnel as may be designated by the Organiser) and their immediate family members, the Organiser’s advertising agents and promotional agents or any other director, member, partner, owner, employee, agent of, consultant to or anyone associated with, affiliated to or involved in the Organiser or the organising and running of the Campaign. The aforesaid persons and entities may not participate in the Campaign.

c. In order to participate in the Campaign, a Participant must have had an active account with the Organiser before 1 January 2017. Participants who have not had an active account with the Organiser before 1 January 2017 may only participate in the Campaign with the Organiser consent, which will be given or withheld in the Organiser’s sole discretion. 

5. Qualifications, Eligibility and Other Requirements:

a. In order to participate in the Campaign, a Participant must be an authorised customer who purchases decorative coatings products from the Organiser.

b. A Participant may not participate in the Campaign if the customer’s account with the Organiser is in arrears at any time during the Campaign Period and/or at the time of claiming a prize. If a Participant’s account falls into arrears during the Campaign period, the Organiser may disqualify the Participant from participating in the Campaign.

c. In order to become entitled to a prize, the Participant must meet, by 30 November 2017, the target set for the Participant by the Organiser. The target will be set by the Organiser in its sole discretion and will be based on the total value of sales orders for the Organiser’s products, which must be achieved during the Campaign Period. The total value of sales orders refers to sales orders, excluding VAT, which have been invoiced by or before the 30 November 2017 and delivered by the 1st week of December 2017. Back orders, un-invoiced orders and undelivered sales orders will not contribute to the value of the order or sales target.

d. In the event of a price increase implementation by the Organiser, the Participant’s target for the remaining Campaign Period will be adjusted by the average price increase percentage.


e. Participants may not return stock purchased during the Campaign Period unless the returned stock is proven to be defective to the Organiser’s satisfaction.


f. Participants may not misuse or abuse the Campaign or be dishonest, unfair or fraudulent in participating in the Campaign. The Organiser may terminate any Participant’s participation in the Campaign if it determines, in its sole and absolute discretion, that a Participant (or any individual connected to a Participant) misused the Program or acted or participated in a fraudulent, unfair or dishonest manner.

g. The Organiser may terminate a Participant’s participation in the Campaign if the Organiser determines that the Participant did not adhere to the Campaign’s terms and conditions.

6. Awarding of Prizes

a. All prizes are awarded at the discretion of the Organiser. The Organiser reserves the right, at its own discretion, to substitute a prize with any other prize of comparable commercial value. The Organiser will not be liable for any defects in any prizes awarded.

b. The Organiser reserves the right to carry out reasonable due diligence to confirm the eligibility of the Participant in order to ensure that the use of any such person in advertising or publicity for the Campaign, the Organiser or its products will not bring the Organiser or any of the Organiser’s affiliates, associates, brands or products into public disrepute, contempt, scandal, ridicule or reflect unfavorably on the Campaign, as determined by the Organiser in its sole discretion.

c. The Organiser’s decision is final and no correspondence will be entered into.


7. Winner Notifications

a. The Organiser will notify winning Participants by sending a message to the e-mail address, the phone number, or mailing address (if any) provided by the Participant at time of entry. The Organiser may also publish details of winning Participants on the Websites. Winning Participants will be notified no later than 31 December 2017.

b. If the Organiser is unable to contact the winning Participant within 7 (seven) days of the winning results becoming known, such Participant may forfeit their prize as may be determined by the Organiser in its sole discretion.


8. Prizes

a. Participants who achieve sales targets of R4 500 000. 01, (excluding VAT) or more:
Participants in this category who achieve their sales targets for the Campaign Period will win a holiday prize to one of a selection of international destinations. The selection of destinations will be determined by the Organiser.  The prize will consist of:

I. Two return air tickets to the destination (additional connecting flights/travel to and from the departure airport are not included);
II. Accommodation for two; and
III. R5 000 spending money.

b. Participants who achieve sales targets between R2 500 000.01 to R4 500 000.00, (excluding VAT):

Participants in this category who achieve their sales targets for the Campaign Period will win a holiday prize to one of a selection of international destinations. The selection of destinations will be determined by the Organiser. The prize will consist of:

I. Two return air tickets to the destination (additional connecting flights/travel to and from the departure airport are not included);
II. Accommodation for two; and
III. R5 000 spending money.

c. Participants who achieve sales targets between R1 000 000.01 to R2 500 000.00 , (excluding VAT):

Participants in this category who achieve their sales targets for the Campaign Period will win a holiday prize to one of a selection of Island destinations. The selection of destinations will be determined by the Organiser. The prize will consist of:


II. Accommodation for two;

d. Participants with sales targets are from R245 000.00 to R1 000 000.00, (excluding VAT):

Participants in this category who achieve their sales targets for the Campaign Period will win a holiday to one of a selection of Local destinations (meaning destinations within the country in which a Participant is operating and the value of the prize will be within the travel budget allocated for this prize by the Operator). The selection of destinations will be determined by the Organiser. The prize will consist of:

I. Two return air tickets, only if applicable (connecting flights/travel to and from the departure airport are not included); and
II. Accommodation for two.

e. If a Participant achieves an actual sales figure in a category higher than the sales target allocated to the Participant (a “higher category”), then the Participant will be eligible to choose only ONE holiday prize that may be from the higher category or any of the categories below it (as described in 8a, b, c, and d above).

f. Winning Participants will have the opportunity to identify the individual who will make use of the prize. That individual will be entitled to choose a travel companion to accompany them on the holiday. Once the relevant individual and their travel companion (jointly, the “Travellers”) have been identified, the prize will have to be used by the Travellers themselves and the prize may not be transferred to anyone else.

g. The Organiser will, in its sole and absolute discretion, determine the travel destinations, relevant airlines and applicable travel class, itinerary and particulars of the flights, air fare and accommodation.

  • Final details regarding the travel destinations and further particulars of the prizes will be announced by end December 2017.

  • If a Participant receives a LOCAL destination prize and the destination’s location is such that flights are not required (as determined in the Organiser’s sole discretion), the prize will not include flights and the Participant will not receive cash or anything else instead of the flights.

h. Prizes will only consist of the items mentioned in paragraph 8 above. All other costs and expenses, including, without limitation, costs relating to additional travel requirements, travel insurance, visas, foreign exchange, immunizations, airport transfers, food and entertainment will be for the Travellers’ own account.


i. Travellers must possess valid passports, visas and travel documents in order to travel to the relevant destination. Winners and their companions will be responsible for obtaining all applicable travel documents at their own cost. 

j. Travel companions must be 18 years of age or older, unless accompanied by the legal guardian.

k. Prizes must be booked at least thirty (30) days prior to departure.  Travel dates and travel are subject to availability and blackout dates.  No refund or compensation will be made in the event of any cancellation or delay of any flight, or if the Travellers are not able to travel on their selected dates.  Travel is subject to the terms and conditions set forth in these terms and conditions, and those specified by the relevant airline and other travel service providers.

l. Travellers may make changes to the travel packages before they have confirmed their arrangements and the bookings have been made, but any additional costs relating to such changes will be for the account of the Travellers. Once Travellers have confirmed their travel arrangements and the bookings have been made, no changes of whatever nature may be made, unless in case of illness or death, provided that the a certified copy of a doctor or hospital letter or a certified copy of a death certificate is provided to the satisfaction of the Organiser.

n. Employees of Participants must ensure that prizes are used and/or distributed in accordance with their employer’s policies. Owners, shareholders, members or management of Participants (as the case may be) must decide who will make use of a prize, if the Participant qualifies for one. A maximum of one prize will be awarded per Participant. The Organiser will not be responsible for any disputes between Participants and their employees, management or other persons.


o. Prizes may not be transferred or exchanged for cash or any other merchandise or services, unless otherwise determined by the Organiser in its sole discretion. If so determined, an International travel prize may be exchanged for R10 000.00; an Island Experience travel prize for R5 000.00 and a Local travel prize for R2 500.00.  


p. All travel bookings must be completed by 28 February 2018 and all travel completed by 31 May 2018. If a Participant has not booked their travel by 28 February 2018 or have not requested a cash amounts subject to the terms stipulated in clause o above, their prize will become null and void and they will forfeit it.

q. Travellers who wants to upgrade to a higher class of travel will be obliged to cover all costs for and relating to the upgrade and any other costs relevant to their travel.    All upgrades must be done before confirming the booking as no changes will be made once the tickets and accommodation have been confirmed.

r. A maximum of 1 (one) prize will be awarded per Participant.

II. Participants can qualify for additional prizes based on them achieving their “Double up” target. Each customers “Double up” target is unique to the customer tier.

s. Winning Participants will be solely responsible for all applicable taxes related to prizes and the acceptance thereof.

t. Prizes may vary from the images and descriptions of destinations depicted on promotional material and website at the discretion of the Organisers.

u. The prizes and everything related thereto are subject to availability. Accordingly, the Organiser will not be liable to any Participant or Traveller if a prize, any aspect thereof or anything related thereto becomes available.

v. Winning Participants must travel between 1 March and 31 May 2018. Blackout dates may apply due to peak season and may not be valid during school holidays; long week-end; Christmas and New Year and other relevant peak times.

w. All costs incurred for travel will be for the account of the Travellers, and not the Organiser, unless the Organiser is responsible for such costs in accordance with these terms and conditions..


9. Privacy Policy

a. Participants’ details will be used by the Organiser to market the Organiser’s products and for the Organiser’s own marketing purposes, and will not be sold to third parties.

b. Once the winning Participants have given consent to the Organiser, the winners will participate in all promotional activities organised by the Organiser (such as publicity and photography) surrounding the winning of the prize, without any payment due to the winning Participants in this regard, making use of his/her name, likeness, image and/or voice (including without limitation photographs, film and/or recordings) in promotional material or in any media for an unlimited period and without remuneration for the purpose of promoting the Campaign (including any outcome), and for promoting any products manufactured, distributed and/or supplied by the Organiser.

c. The identity of the winning Participants must be kept confidential until the winners’ identity is publicly revealed by the Organiser.

d. Winners’ names may be posted on the Organiser’s Websites at www.plascon.co.za, www.xploreplascon.com and social media site: www.facebook.com/PlasconSA


10. Postponement and/or Suspension

a. The Organiser and its third-party suppliers, as the case maybe, reserve the right to vary, postpone, suspend, or cancel the Campaign and any prizes or any aspect thereof, without notice at any time, temporarily or permanently, for any reason that they deem necessary. In the event of such variations, postponement, suspension or cancellation, the Participants and winning Participants agree to waive any rights, interests and expectations that they may have in terms of this competition and acknowledge that they will have no recourse against Kansai Plascon (Pty) Ltd., its affiliates, employees, agents, contractors and third-party suppliers.


11. Liability

a. Participation in this Campaign and subsequent use of the prizes is at OWN RISK. Participants and winning Participants hereby indemnify and hold harmless the Organiser, its partners, employees,
